Presentation

This study cycle has two specialties, Legal-Civilistic Sciences and Legal-Criminal Sciences, and the student must choose one of the areas. Each area of expertise comprises six mandatory units (three in each half) plus one elective per semester according to the study plan.

Phd degree is awarded to those who obtain:

  • approval in the academic part (60 ECTS)
  • PhD thesis preparation, within six semesters, discussion and approval in public exams (180 ECTS).

*8 places in total for application (shared by the two specialisations of this Doctorate).

Why choose this course?

The course of study has the general objective of promoting the creation of knowledge in Legal Science, developing human resources to design, implement and coordinate scientific research projects advanced level. Thus the following specific objectives should be pursued:

  • Understanding an integrated way the legal system;
  • Encourage reflection on the law;
  • Encourage interdisciplinary discussion and studies in border areas;
  • Promote the integration and interaction of national and international academic community;
  • Develop the ability to build and run, methodically, a personal research project with original results;
  • Develop the ability to design and manage research projects that promote scientific research team and links to other institutions, national and international.
Career Prospects

All the legal professions, namely magistracy, advocacy (litigation direction), research, higher education, senior civil service officials.

Objectives

The study cycle of learning objectives correspond to level 8 of the European Qualifications Framework for Learning throughout life (EQF) according to the European Space Qualifications Framework for Higher Education. Completion of the course involves a systematic and comprehensive understanding of the Legal Civil Sciences or Criminal Sciences, as well as the Epistemology and Methodology of Research in Legal Science. Graduates will be able to critically analyze, evaluate and synthesize ideas and innovative and complex reasoning and will be also able to communicate with their peers, the academic community and society in general about their area of expertise.

Diploma or Certificate Awarded

The present diploma confers the qualification in PhD degree in law: Specialty in Legal-Criminal Sciences (240 ECTS) or, with the conclusion of the 1st year, Advanced Studies in Legal Sciences: Specialty in Legal-Criminal Sciences (60 ECTS).

Scientific Area

The Doctorate is organized in 2 semesters that correspond to the curricular structure, plus 3 years dedicated to the preparation, realisation and presentation of a thesis defense.
The course is equivalent to 60 ECTS for the curricular part and 180 ECTS for the preparation, realisation and presentation of the thesis, which makes a total of 240 ECTS in the following scientific areas:

Note: The optional CUs available will be defined annually by the Department Direction.

The doctoral students will be integrated into the IJP/ Portucalense Legal Institute, research unit recognized by the Science and Technology Foundation, with the purpose of developing scientific research activities. The doctoral theses will be framed in research projects that are underway by consolidated groups and integrated into R&D units with a body of knowledge production that is internationally recognized in the area of the study programme. IJP’s action is in accordance with the purposes of the European Research Area (ERA), assuming itself as a research centre integrated in the scientific community and in the civil society, at national and European level, with the mission of sharing and disseminating scientific knowledge in the fields of Law, Political Science, International Relations and other related areas.

Specific Conditions for Admission
Applications for admission to the cycle of studies leading to a doctoral degree may be made by those who meet the conditions laid down in DL 74/2006, 24th March, amended in DL 115/2013, 7th August and amended and republished by DL 63/2016, 13th September. Namely:
  1. Holders of a Master’s degree or legal equivalent in Law or related areas;
  2. Holders of a bachelor’s degree in Law or related areas, holding a particularly relevant academic or scientific curriculum vitae that is recognized as attesting the capacity to carry out this cycle of studies by the Scientific Council of Portucalense University;
  3. Holders of an academic, scientific or professional curriculum vitae that is recognized as attesting the capacity to carry out this cycle of studies by the Scientific Council of the Portucalense Infante D. Henrique University.
Selection/Seriation Criteria

The candidates for access to the 3rd cycle in Legal Sciences are selected and ranked by the Coordination Office of the study cycle, in descending order, according to the final classification calculated by applying the criteria and respective weighting presented in Annex II of these Regulations.

The Application Process must be completed with

  1. Application form, duly completed;
  2. Documents proving that the candidate meets the conditions for candidacy;
  3. Originals or certified copies;
  4. Detailed and updated Curriculum Vitae;
  5. Identification document
    Up-to-date colour photograph;
  6. Other documents indicated in the regulations of the course to which the applicant is applying;
  7. Other documents that the candidate considers useful (namely a Letter of Motivation/Intent – draft for the Doctorate in Clinical Psychology and Counselling – and also required for the Doctorate in Business Administration). If you wish to apply for equivalences:

  • Application for Recognition and Creditation of Competences in accordance with regulations in force (including syllabus contents and hour loads of the subjects to which equivalence is to be requested and discriminative certificate (*) (**)with the grades obtained).

(*) These documents must be authenticated according to the legislation in force (Decree-Law 28 of 13/03/2000).

(**) The documents must be translated into Portuguese, whenever they are not issued in Portuguese, English, French or Spanish and stamped by the consular service or presented with the Hague Apostille affixed by the competent authority of the State from which the document originated. Adds

Re-entries are requested to the Direction of Admission and Student Support Services, using the appropriate form.

  • Application for recognition and creditation of competences, according to the regulations in force, in case the student intends to apply for the equivalence of competences other than those acquired in the course to which he/she re-enters.
Scholarships

The Doctoral Programme in Business Sciences of Universidade Portucalense has two scholarships (with a maximum duration of 48 months), funded by the Foundation for Science and Technology (FCT), to be awarded to full-time students.

Universidade Portucalense also offers a set of scholarships for the doctoral programmes in Legal Sciences and in Clinical Psychology and Counselling that cover the tuition fees. All candidates to these doctoral programmes are automatically eligible for these scholarships after formal enrolment. The number of scholarships to be awarded, together with the award criteria will be defined in due time, in a specific dispatch.
